Why do I need an estate plan rather than a will?

Some states give a will more power than other states. However, California is NOT one of them. Here in California, if you simply have a will and forego creating a complete living trust, your estate will be subject to probate. A will does not protect from probate, federal estate taxes or provide asset protection. A comprehensive living trust (or an estate plan) can provide protection from probate, federal death taxes, and asset protection. It is the preeminent document that you can create and is recommended for assets here in California.
