What is a default divorce?

A default divorce is one where the respondent party simply does not respond.  If you are in agreement with each other, this type of divorce is a great option because it only requires one party to pay attorney fees, and court fees.  The other party simply does nothing.  After 6 months and one day, you can be divorced.  The minimum wait period requirement for divorce is 6 months in California.  Default divorces are great options for couples that are communicative and want the process to be done more cost effectively.  If, on the other hand, you were not served and your spouse is asking for a default divorce, you have limited time to set aside the default and you should contact your attorney right away.  For more information about this, or any of our legal services please call us for a FREE phone consultation!
